    What's amazing to me is that the Democrats have Shifty Shiff as the face of their prosecution. That's like putting Al Capone in charge of IRS Collections.
    The first to state his case seems right until another comes and cross-examines him.

      That's ... not how impeachment works. SCOTUS gets to decide a lot of things but it doesn't get to tell a house of Congress how to run its hearings.

      But we're certainly seeing how the "law and order" folks are shaking out, I guess.

        Impeachment is a political process, not a criminal one - and both sides are playing politics.
        The first to state his case seems right until another comes and cross-examines him.

          Bad comparison. Not liking Schiff doesn't equate to Schiff acting inappropriately, to say nothing of unlawfully.

          Schiff has been one of the Democratic leaders wary of impeachment. He's got the job because 1) Pelosi reportedly doesn't like how Nadler's handling his hearings and 2) the Ukraine/whistleblower incident is, for now, the main show and it landed in HPSCI.

            Right, yes - it's a political matter between the executive branch and the legislative. SCOTUS doesn't really get to dictate how that shakes out.

              It's not a matter of "not liking" Shiff, Sam - besides being an extremist political hack, he's made himself a fact witness in the process, for which he should recuse himself.

                SCOTUS has every right to determine if something is unconstitutional, should the matter rise to their court - that's their job.
                The first to state his case seems right until another comes and cross-examines him.

                  This is incorrect. Schiff is not a fact witness in any proceeding. You're thinking of one of the HPSCI staff who directed the whistleblower to file a complaint with ICIG.

                  At the very -most-, that staff member could be deposed to assess if he or she coordinated at all with the content of the the complaint ... but it'd be a short and unfruitful deposition, according to all reporting. Schiff did not meet with nor communicate with the whistleblower, by all accounts.

                    Unconstitutional how? The House has the explicit power to impeach, the Senate to try. Both have the power to set their own rules regarding those processes.

                    SCOTUS' input, if any, would be exceptionally limited.

                      They certainly can decide if Trump is in the right to assert Executive Privilege. If he is the Dems would have no legal right to his cooperation. They are going to impeach either way - why hand them anything...

                            Assuming we accept Marbury (not everyone does), yes. And the Court left this avenue open in a previous case.
