Comey drafted Clinton exoneration before finishing investigation, GOP senators say

Former FBI Director James Comey drafted a statement exonerating former Secretary of State Hillary Clinton for running her government emails through a private email server before completing the investigation, according to two Republican senators.

Comey prepared the draft exoneration for Clinton before conducting interviews with top Clinton aides who were offered immunity for their cooperation, Senate Judiciary Chairman Chuck Grassley and Sen. Lindsey Graham said Thursday in a joint statement, citing transcripts of interviews with former Comey aides obtained by the Senate judiciary committee.

Comey would go on to announce in July 2016 that the FBI would not recommend charges against Clinton -- although he sharply chastised her decision to conduct State Department business through a private email server.

"Conclusion first, fact-gathering second -- that's no way to run an investigation. The FBI should be held to a higher standard than that, especially in a matter of such great public interest and controversy," Grassley and Graham wrote in a letter to FBI Director Christopher Wray seeking more information -- including all drafts of Comey's final statement on Clinton's emails by September 13.

The speech Comey gave set a very high standard for prosecution - he said that wasn't going to prosecute Clinton because "no reasonable prosecutor" would bring a case unless there was intent to disseminate classified information. Since nobody was accusing Clinton of trying to disseminate information (they were accusing her of trying to hide information), what I wondered at the time was: "Why didn't Comey give that speech right at the start of the investigation? Why did he bother to do the investigation for months and months, only to eventually admit that there was nothing they were interested in prosecuting there and that they'd known that from the start?"

Essentially this story confirms I was right: They did know from the start that there was nothing there worth prosecuting. The question becomes, why did they waste time and resources with a year long investigation they knew wasn't going to go anywhere? Did they feel pressured by Republicans to waste money on a gratuitous investigation that they knew all along was a nothingburger?

Comey was full of crap. Mishandling classified information is a crime in and of itself regardless of intent, and there are people currently sitting in jail who did far less than what Hillary is guilty of. It would have been a slam-dunk conviction for any prosecutor.

But the networks sure did. Despite having a combined total of 9½ hours of air time on Thursday night and Friday morning (when you factor in shows like Today and Good Morning America there was no mention whatsoever.

Comey claimed under oath that his decision not to recommend indictment came at the end of the investigation, but it appears he had made the decision weeks before while the investigation was still ongoing.
