  • SCOTUS & gay wedding cakes

    This story is just breaking:

Source: Supreme Court rules in favor of baker who denied same-sex couple a wedding cake

The Supreme Court rules narrowly for the Colorado baker who wouldn't make same-sex wedding cake.

The clash at the high court pitted baker Jack Phillips' First Amendment claims of artistic freedom against the anti-discrimination arguments of the Colorado Civil Rights Commission, and the two men Phillips turned away in 2012.

This is a developing story and will be updated.

The ruling was 7-2? Wow. So much for "the conservative court...."

If it was 7-2 that contradicts the claim it was a close decision

The case pitted Jack Phillips, the owner of Masterpiece Cakeshop in Lakewood, and the couple, Charlie Craig and David Mullins.

The court ruled that the Colorado Civil Rights Commission’s actions violated the free exercise clause.

In arguments before the court in December, Justine Anthony Kennedy, the author of all the court’s major gay-rights cases, worried that a ruling in favor of Phillips might allow shop owners to put up signs saying “We do not bake cakes for gay weddings.”

But later, Kennedy said the Colorado Civil Rights Commission seemed “neither tolerant nor respectful of Mr. Phillips’ religious beliefs” when it found his refusal to bake a cake for the gay couple violated the state’s anti-discrimination law.

The case pitted Phillips’ First Amendment claims of artistic freedom against the anti-discrimination arguments of the Colorado commission, and the two men Phillips turned away in 2012.

As some of us have been saying, this goes to "artistic freedom".

OK, this is weird. CNN says it was a "narrow ruling", and "6 - 2". Even that can't be called a "narrow ruling".

Washington (CNN)The Supreme Court ruled narrowly in favor of a Colorado baker who refused to bake a cake to celebrate the marriage of a same sex couple because of a religious objections.
              The ruling was 6-2.

Since the article says it's subject to change, I'll add a screenshot.

Source: Supreme Court sides with Colorado baker who objected to making cake for same-sex wedding

The U.S. Supreme Court ruled Monday in favor of Colorado baker who objected to making a cake for a gay couple’s wedding.

The justices ruled 7-2 against the state of Colorado, reversing a ruling from the Colorado Court of Appeals in one of the court’s most high-profile cases of the term. Justices Ruth Bader Ginsburg and Sonia Sotomayor dissented.

The case, like other blockbuster cases before the high court, hinged on Justice Anthony Kennedy’s vote. Kennedy wrote the Supreme Court’s 2015 decision legalizing gay marriage and delivered the majority opinion for the court in the case.

The case, Masterpiece Cake Shop Ltd v. Colorado Civil Rights Commission, was a dispute between Jack Phillips, a baker in Colorado, and Charlie Craig and Dave Mullins, a gay couple who asked Phillips to bake a cake for their wedding reception.

Phillips told the couple he didn’t make cakes for same-sex weddings.

Craig and Mullins then filed a complaint with the Colorado Civil Rights Commission after learning the state’s public accommodations law barred discrimination on the basis of sexual orientation.

The commission ruled in favor of the gay couple, and a state appeals court agreed.

The justices were tasked with determining whether Colorado’s public accommodations law violated Phillips’ free speech rights, as the baker’s lawyers argued it forced Phillips to engage in speech that violated his religious beliefs.

In the wake of the Supreme Court’s landmark ruling legalizing gay marriage, florists, bakers, photographers and other business owners nationwide have been embroiled in legal challenges after turning down wedding services to same-sex couples due to their religious beliefs.

Courts often rule against the business owners, though, due to state laws that require businesses to serve customers regardless of sexual orientation.

A 7-2 decision hardly hinges on one justice's vote.

I have read some of the majority opinion - it is narrow in that you just can't refuse to serve anyone who comes into the shop. But you can on special orders that require further artistice work by the owner if it violates his religious beliefs. Pretty much what we have arguing here.

USA Today, Business Insider, and the New York Times are all also reporting that this "narrow decision" was 7-2.

ETA: And so is the Chicago Tribune and CNBC (the latter includes a copy of the decision).

They have revised it to stating a 7-2, but still call that a narrow ruling. What a bunch of dunderheads!

I think they mean narrow in how the ruling can be applied.

OK, maybe so, especially from this paragraph....

The ruling, written by Justice Anthony Kennedy, is not the wide-ranging ruling on religious liberty that some expected. It is tailored to the case at hand with the justices holding that members of the Colorado Civil Rights Commission showed animus toward Phillips specifically when they suggested his claims of religious freedom was made to justify discrimination.

How does that explain comments like "the case, like other blockbuster cases before the high court, hinged on Justice Anthony Kennedy’s vote" then?
