Where is this part from? In the articles I looked up about it, all I find is the fairly vague statement that the officer accidentally entered the wrong apartment and then subsequently shot him. The implication I took was that she opened the door on her own (was it unlocked?) and then shot Botham subsequently, not that Botham opened the door and was shot. Could you provide the source for this? Because the sources I've found are fairly vague and do not include the information you post here.Originally posted by firstfloor View PostComment

This is clearly a tragic accident. She called it in straight away. There was no law enforcement issue except what she imagined and no malice. So, you look at the circumstances; fatigue and what other things made this possible. An accident investigation approach is needed or else you end up failing to fix the underlying problem. The investigation is being handled by the Texas Rangers. This often happens when it's likely that the officer-involved shooting is not considered "righteous", and a prosecution will ensue.
After initially seeking a manslaughter warrant for the off-duty Dallas Police Department officer who shot and killed Botham Shem Jean after she entered Jean's apartment, believing it was her own, DPD backed off, Dallas Police Chief U. Renee Hall said early Saturday afternoon.
"We were in the process of obtaining a warrant for the officer when we called the Texas Rangers in," Hall said. "We have since turned that investigation over to the Texas Rangers because we truly want to be transparent."

Story on Heavy.com by Jessica McBride quoting Steve Eagar from Fox 4 News who apparently got it from Dallas police.
