    A federal judge in New York has struck down the Trump administration's proposal to reintroduce a citizenship question into the 2020 census.

    The ruling effectively puts a freeze on a deeply contentious move that critics said would discourage non-citizens from participating in the Census. The Justice Department has said it needed better data on the voting age population to help enforce the Voting Rights Act.

    Judge Jesse Furman said Tuesday morning that the proposal is "unlawful," writing that "(Commerce Secretary Wilbur Ross') decision to add a citizenship question to the 2020 Census -- even if it did not violate the Constitution itself -- was unlawful for a multitude of independent reasons and must be set aside."

            Does being illegal make the Constitution not applicable to them? (Asking for a friend ) If it doesn't, (negate it) then the right against self incrimination would be in effect. If it does then NVM...

              I think that they are subject to the jurisdiction of their current location, which means that the laws they would be prosecuted under would be bound by the constitution, so yeah they get the benefit of all of the rights such as not incriminating themselves, a jury of their peers, etc.

                    There are also many people here legally who are not citizens. For voting purposes, it really does help to know what proportion of the population is eligible to vote.

                            But ....

                            The Census is a crucial document for determining how federal funds are allocated and how congressional districts are drawn for the following 10-year period. It is meant to account for everyone living in the United States, not just US citizens. The citizenship question has not been asked of all recipients since 1950.

                              Depends on what the purposes of the census are. Usually a key use of census data is for every level of government to be able to use it to know how many people are in their particular area. So it's generally more important that the head-count is accurate than it is to know anything at all about those people.
