I don't follow all the reasoning. IANAL. It will be interesting to watch out how the case turns out. However, anyone acting like this is open and shut--on either side--is simply arguing for the tribe, imo.

Unless he is on tape explicitly saying he's going to pay her off in order to help his campaign nobody can prove it wasn't done in order to keep his wife and family from finding out (a very big likelihood). There is nothing illegal about that.

I get your reasoning. There are a lot of very rich people who are going to make millions of dollars more splitting legal hairs over this--it's their reasoning that I'm thinking about here. Trump does not necessarily think ahead and Cohen is a snake who keeps records.
