    Dallas Salon Owner Sentenced to 7 Days Behind Bars for Reopening Too Soon

    A Dallas salon owner was sentenced to seven days behind bars Tuesday for disobeying coronavirus shutdown orders, doing business well ahead of even the aggressive reopening plans in Texas.

    Dallas County Judge Eric Moye held Shelley Luther, owner of Salon À la Mode, and her corporate entity, Hot Mess Enterprises, in criminal and civil contempt.

    Moye told Luther she owes local leaders an apology and called her decision to open early selfish.

    "I have to disagree with you, sire, when you say that I am selfish because feeding my kids is not selfish. I have hair stylists that are going hungry because they'd rather feed their kids. So sir, if you think the law is more important than kids being fed, then please go ahead with your decision. But I'm not going to shut the salon," said Luther.

    Yay. If the lockdown were a week long, it was sort of an emergency decision. But this shutdown has been experimental and based on much media hype. The approach has proven to be flawed. There should never be acceptance of this again, especially not at a state level (unless the state is the size of Rhode Island or smaller). Maybe counties could make a decision. But we have seen that "essential" companies seemed to be based on governor preference instead of logic. Plus, the differences between who was open and who was shutdown was aribitrary -- instead of just the ability to maintain physical distancing. (Whoever came up with the crappy name "social distancing"?)

    We also were given the initial promise of flattening the curve so that hospitals were not overloaded. Well most hospitals were nearly empty. So the flattening went way too far in most places. So, Shelley's action was proper -- open up the economy again as best as she could.

    I just wish more people were as responsible in the preservation of freedom as Shelley Luther.

      Yes, Shelley Luther is selfish for wanting to support her family, while this piece of crap judge is being paid with tax payer money...

          That is a common tactic to make the opposition sound like its actions (or statements made) were a temporary lapse of common decency. I think this demonstrates the effort to psychologically control people rather than have truth be known or justice be accomplished. Hence, it shows the judge acting totally inappropriately.

              On what basis is one to empowered to defy a lawful order such as this one? Given that even bright red states implemented social distancing it can't be that the constitutionality of such orders is in serious question.

                Given that there is a 0% chance of her opening her salon early, or probably even on time now, I'd say she successfully fleeced a lot of suckers to line her own pockets. Of course, she can prove me wrong by giving the excess contributions beyond rent + her salary to the employees she claims to have done this on behalf of...

                  The constitutionality of enforcement depends on whether the law first was constitutional. Which it wasn't square on constitutional -- but there might be forgiveness in a narrowly defined emergency event -- not a 90 day quarantine. The other is whether the law is applied to people of equal situation. It could readily be argued that there are other companies that were open which would be more of a threat healthwise. Another, is the emergency order designed properly for the degree of the emergency. If the quarantines were designed to flatten the load on the hospitals while the hospitals remain empty, then the quarantine is hardly justified.

                  The arresting officers also may be personally liable for violating our rights as protected by the US and State constitutions. So, there is plenty of constituional issues here. Did I miss anything?

                    She seems to be covered financially from people who support her advocacy for freedom. I'm sure the other workers can open the salon. We'll see.

                    Next time, I hope you are on the side of freedom. You have the freedom to stay quarantined in your home while responsible people make the economy work for everyone's behalf.

                          75K dead even when massively undercounting. More dead than Vietnam. 7th most deadly event in US history, soon to be 6th most deadly.

                            Made me wonder if I could correctly name in order what the most deadly events were in US history...

                            I got the 5 major wars correct in their order of deadliness for Americans, but waaay underestimated the pandemics, and how many of those there had actually been in the 20th century.

                            The rate things are going with Covid in the US, I wouldn't be surprised if it reaches #1.

                              48 out of 50 states had laws prohibiting the desecration of the American flag (this would obviously include both liberal and conservative states), the SCOTUS still struck them all down as violations of the First Amendment. (I suppose someone could argue that the SCOTUS made the wrong decision)

                              7th/6th most deadly in terms of body count, or in terms of percentage of the population? Because it's much easier to rack up high numbers with a larger population. If three million people in the US suddenly died just now, that would be about 1% of the population. If three million people died in 1790, that would be about 75% of the total population. I feel percentage is a better indicator.
