Unless he escapes, which does happen occasionally, or they end up parolling him or grandfathering out the old folks. With death it is a sure thing.

Interesting idea. It would help setup some good shootouts too. With the death penalty so assured, it'll give murderers a good motive to go out shooting and take some cops with him.
