  • Surrogate. Mothers

SPECIAL NOTE: Mods have given a dispensation to allow a crossover thread so debate can proceed in another thread. This one is to focus on the protection of surrogate moms. This will be an interesting experiment.

Thoughts on what protections surrogate moms should have, and should seek to avoid this situation?

I'll start with the obvious. Let it be clear up front that abortion is not an option. But it seems even then there can be loopholes in the legal system? And it occurs to me that it just as easily could be the parents that don't want abortions. How should the law protect such wishes?

Frankly, I'm not sure the law can protect such wishes outside of enforcing contractual agreements. Things that aren't specifically enumerated (like a maximum number of children) can't really be enforced, afaik.

It's silly that abortion is the go-to answer instead of adoption.

....can a case be made for sex (no jokes! ) discrimination in her case? Singling out the gender as a reason for the demand?

I don't understand why the parents would be so averse to adoption, and insist on abortion.

Because it's their property, ofc. You don't just give that stuff away.

I don't support surrogacy (is that a word?) ... seems to invite a lot of problems such as this one! I recall in years past that the restrictions were that the surrogate mom was to already had kids, and be older. Makes sense...you want to know that the baby will take, and less chance of mom getting overly attached to the baby. Now you have young girls renting themselves out. To be fair, this young woman seems to be mature. Seems.

I don't have kids, and I can't imagine the desperation of childless couples. Having written that, I have to wonder just how far they should go to get just what they want. Unscrupulous young women or parents could really take advantage of the desperation.

The contract MUST be ironclad against abortion. CAN it be?

Here's an update that includes both women involved in this issue. They're no longer talking to the press since they got the lawyer. The article, I think, is a pretty good overview of the problems of surrogate pregnancies. I'm becoming less and less in favor of the practice.

This link shows what surrogate parents SHOULD do IMHO...pay their way.

                        update:

Surrogate mother, 48, who was paid $33k for triplets files for custody after the father demanded that she abort one of the babies 'because he couldn't afford to care for it'

Melissa Cook, 48, agreed to carry children for Georgia man named as CM
During pregnancy he tried to get her to abort one of three babies because he argued he could not afford to care for triplets
As Cook refused she says he threatened to bankrupt her with medical bills
She gave birth to triplets in February before they went to live with father
He is thought to be a deaf postal worker, 50, who lives with his parents
Now she is suing for custody saying they are not being properly cared for

According to Cook, CM became 'scared' and admitted through his lawyer that he did not have the financial means to raise triplets, before demanding that she abort all three babies despite them being healthy.

After arguments back and forth, Cook says CM's lawyer eventually demanded that she use selective abortion to get rid of just one of the babies, despite the substantial risk of killing the other two.
                        ...
Cook claims CM also said he would put one of the babies up for adoption because he could not afford it, and that when she offered to take the child, he said he would rather a stranger had it.

When the babies were eventually born on February 22, after 30 weeks of pregnancy, Cook says they were taken away from her in the delivery room because CM did not want her to see them.

                        ...

To be honest if in Surrogacy, the contract needs to be drawn up and agreed to by both parties before the babies are conceived (this is not a pro or against abortion) This way if you have more than x babies mom can decide how to handle the pregnancy herself which should be in the contract as well. AKA Adopting parents pay for medical bills relating to # of babies they are adopting, and mom handles the rest through pregnancy medicaid or insurance.
                          Just a thought
